No Hotdog∙Terms of Service
Welcome to No Hotdog! We are a social platform where people can protect animals and our climate.
These Terms of Service ("Terms") govern your access to and use of the No Hotdog website, app, and services (collectively, the "Service"). By using our Service, you agree to be bound by these Terms.
1. Eligibility and Age Requirement
You must be at least 13 years old to use the Service. To make any payments, including purchasing a subscription or a gift, you must be at least 18 years old or the legal age of majority in your jurisdiction.
2. Your No Hotdog Account
You need an account to use most features of No Hotdog. You can create an account using Google sign-in. You are responsible for all activity that occurs under your account, so please keep it secure.
3. The No Hotdog Service
No Hotdog provides several ways to contribute to our mission:
A recurring monthly subscription that funds our "Impact Fund," a portfolio of high-impact charities and projects.
One-time purchases that fund specific initiatives. You can customize a virtual gift with an image and text and share it with others.
4. Important Disclaimers About Impact
We want to be as transparent as possible about our impact numbers:
All figures related to impact (e.g., "protects 100 shrimp," "offsets 10 flights") are good-faith estimates, not guarantees. They are calculated using models provided by third parties like FarmKind.
Our offerings are not certified carbon offsets. They represent our best effort to fund projects that create a positive impact.
We perform due diligence on the charities and projects we fund, but we are not responsible for their ultimate success or failure.
We provide the Service "as is" without any warranties.
5. Payments, Subscriptions, and Refunds
We use Stripe, Inc. ("Stripe") to process all payments. When you make a purchase, you provide your payment information directly to Stripe and are subject to their terms and privacy policy.
Memberships are recurring. You can manage, pause, or cancel your subscription at any time through the Stripe customer portal, which is accessible from your No Hotdog account settings. Cancellations will take effect at the end of your current billing period.
Payments are final and non-refundable. We may, at our sole discretion, offer a refund in certain situations, but we are not obligated to do so.
We only charge a small fee (3%) to cover Stripe's processing fees, meaning that almost all of your contributions go directly to the charities or projects we fund. However, we reserve the right to introduce a service fee in the future. We will provide you with at least 30 days' notice before any such change affects your subscription.
Contributions made through No Hotdog are purchases, not donations, and are not tax-deductible.
6. User Content
You can create custom gifts by uploading your own images and adding text ("User Content").
You retain ownership of the User Content you create.
By submitting User Content, you grant No Hotdog a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute your content as necessary to provide, promote, and market the Service. For example, we need this license to show your gift on our website, share it via a link, or feature it in our marketing materials.
You are solely responsible for your User Content. You agree not to submit any content that is illegal, hateful, sexually explicit, or infringes on the rights of others (like copyrights or trademarks).
We reserve the right to remove any User Content at any time for any reason.
7. Termination
We may suspend or terminate your account if you violate these Terms. You can delete your account at any time by contacting us.
8. Limitation of Liability
To the fullest extent permitted by law, No Hotdog (and its founder) shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising from these Terms or the Service is limited to the total amount you paid to No Hotdog in the past twelve (12) months.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules.
Any dispute arising from these Terms will be resolved through binding arbitration, conducted on an individual basis. This means you waive your right to a jury trial and to participate in a class-action lawsuit.
10. Changes to These Terms
We are a new service, and our Terms may change. We will post the updated Terms on our website. Your continued use of the Service after changes are made constitutes your acceptance of the new Terms.
